Materials on proposed vacation of Sheep Pen Road now online

DOVER – Delaware’s Department of Transportation has announced materials related to the proposed vacation of Sheep Pen Road in Sussex County are now available online at

At that site, interested parties can find a copy of the form used to gather public comment about the proposed vacation, a map of the area surrounding Sheep Pen Road, a transcript of a public hearing about Sheep Pen Road held Aug. 9 and a list of questions taken from that transcript.

DelDOT has requested that answers be provided by Sept. 8.  Once they are received and reviewed they will be posted for public access.

DelDOT is no longer accepting comments about the proposed vacation.

By the end of September, State Secretary of Transportation Jennifer Cohan will receive a recommendation about whether to vacate Sheep Pen Road. She will make a decision about the vacation afterward.

Once Sec. Cohan makes her decision, Delaware residents will have 30 days to appeal the decision in the Delaware Superior Court in Sussex County.

If no one appeals the Secretary’s decision, it will be final.
